How the dates are worked out
- Due date = first day of the last period + 280 days + (cycle length − 28).
- Pregnancy week = days since the (adjusted) last period ÷ 7.
- Maternity leave: 98 consecutive days including rest days and public holidays; the first day counts as day 1.
- Allowance = ordinary daily rate of pay × 98 (at least RM6 a day).

Conditions to know
- Maternity allowance: 90 days' work in the 9 months before confinement, with the employer in the 4 months before, and fewer than 5 surviving children; the leave is still given without allowance otherwise.
- Confinement means a birth after at least 22 weeks; a miscarriage before that is not maternity leave.
- Returning early within the 98 days needs a doctor's certificate and the employer's consent.
- The Ministry of Health recommends at least 8 antenatal visits during pregnancy.
- Plan for your child's schooling with the education cost calculator.

Frequently asked questions
How is the due date worked out?
Add 280 days (40 weeks) to the first day of the last period, plus the difference between your cycle length and 28 days. A last period on 1 January 2026 gives a due date of 8 October 2026; a 30-day cycle makes it 10 October 2026. An early ultrasound scan is usually more accurate.
How many days of maternity leave are there in Malaysia?
98 consecutive days for private-sector employees under the Employment Act 1955 since 1 January 2023, and in Sabah and Sarawak since 1 May 2025. Civil servants currently get 60 to 90 days per birth; Budget 2027 announced 98 days but the start date has not been announced.
When can maternity leave start?
No earlier than 30 days before the confinement. With a due date of 8 October 2026 and leave starting 30 days early (8 September), the 98 days end on 14 December 2026; starting on the day of birth, they end on 13 January 2027.
Who qualifies for maternity allowance?
An employee who worked at least 90 days in the 9 months before confinement, was employed by that employer in the 4 months before, and has fewer than 5 surviving children. The allowance is the ordinary daily rate of pay for each day of leave, at least RM6 a day.
How many days of paternity leave are there?
7 consecutive paid days for a husband in the private sector with 12 months' service with the same employer, up to 5 confinements. Give notice at least 30 days before the due date. Civil servants also get 7 days, up to 5 times.
When do the second and third trimesters start?
The second trimester starts at week 14 and the third at week 28. A baby is early term from 37 weeks, full term from 39 weeks and post-term from 42 weeks.
Can an employer dismiss a pregnant employee?
No. Section 41A of the Employment Act bars terminating a pregnant employee, or one ill from the pregnancy, except for misconduct, breach of contract or business closure, and the employer must prove it. Termination during maternity leave is also barred.
