The overtime formulas
- Ordinary rate of pay (ORP): monthly wages ÷ 26 (section 60I). Daily-rated employees use their daily wage.
- Hourly rate of pay: ORP ÷ normal hours of work in a day.
- Normal day overtime: at least 1.5 × the hourly rate for each hour (section 60A).
- Rest day: up to half the normal hours, ½ day's ORP; over half, 1 day's ORP; beyond the normal hours, 2 × the hourly rate (section 60). Daily-rated: 1 or 2 days' wages.
- Public holiday: 2 days' ORP on top of holiday pay; beyond the normal hours, 3 × the hourly rate (section 60D).

- whatever they earn: manual workers, drivers and operators of mechanically propelled vehicles, supervisors of manual workers, and domestic employees.
Normal hours are capped at 8 a day and 45 a week, and overtime at 104 hours a month. Sabah and Sarawak have their own Labour Ordinances.

Frequently asked questions
How is overtime pay calculated in Malaysia?
Divide the monthly wages by 26 to get the ordinary rate of pay (ORP), divide that by the normal hours in a day to get the hourly rate, then pay at least 1.5 times the hourly rate for each overtime hour on a normal working day. On RM2,600 and an 8-hour day, ORP is RM100, the hourly rate RM12.50 and overtime RM18.75 an hour, so 10 hours is RM187.50.
Who is entitled to overtime pay under the Employment Act?
Since 1 January 2023 the Employment Act covers all employees in Peninsular Malaysia and Labuan, but the overtime, rest-day and public holiday rates are guaranteed only to those earning up to RM4,000 a month, and to manual workers, drivers, domestic employees and supervisors of manual workers whatever they earn. For others, the employment contract sets the overtime terms.
How much is rest day pay?
For a monthly-rated employee, working up to half the normal hours on a rest day pays half a day's ORP, and working more than half up to the normal hours pays one day's ORP. Hours beyond the normal hours pay at least twice the hourly rate. On RM2,600 that is RM50, RM100 and RM25 an hour. Daily-rated employees get one or two days' wages instead.
How much do I get for working on a public holiday?
Two days' wages at the ordinary rate of pay on top of the holiday pay you already receive, and at least three times the hourly rate for hours beyond the normal hours. On RM2,600 that is RM200 for the day plus RM37.50 for each overtime hour.
What is the overtime rate at the minimum wage?
At the RM1,700 minimum wage and an 8-hour day, the ordinary rate of pay is RM65.38, the hourly rate RM8.17 and overtime RM12.26 an hour on a normal day.
What is the maximum overtime allowed in a month?
104 hours a month under the Employment (Limitation of Overtime Work) Regulations 1980. Normal hours are capped at 8 a day and 45 a week since 1 January 2023.
Is overtime counted in the 26-day rate?
No. The ordinary rate of pay is based on wages, which exclude overtime payments, so overtime does not raise the rate used to pay further overtime. Fixed allowances that form part of wages are included.
