How faraid is worked out

  1. Deduct funeral costs, debts, harta sepencarian and any bequest to non-heirs (at most 1/3 of what is left).
  2. Find excluded heirs (mahjub), for example grandchildren by a son and siblings by the father.
  3. Give the fixed shares (ashab al-furud); if they exceed the estate, raise the base ('awl).
  4. Give the residue to the residuaries in order; if there are none, to Baitulmal (or radd in Perlis).

The estate process in Malaysia

  • Sijil Faraid is issued by the state Syariah High Court on the death certificate and the heirs' identity cards.
  • Small estates (up to RM5 million with no civil will): the JKPTG estate distribution unit, through MyLand.
  • Summary estates (movable property only, up to RM600,000): Amanah Raya Berhad.
  • Larger estates or with a will: the civil High Court (probate or letters of administration).
  • Hibah given in life and EPF money paid to a nominee are outside faraid. Work out zakat with the zakat calculator.

Frequently asked questions

How is an estate divided under faraid?

After funeral costs, debts, harta sepencarian and any bequest (at most 1/3) are taken out, fixed-share heirs such as the husband, wife, mother, father and daughters receive their fractions, and the rest goes to residuaries such as sons. Example: RM285,000 for a wife, mother, one son and two daughters gives the son RM 100,937.50 and each daughter RM 50,468.75.

What is the wife's share in faraid?

1/8 if the deceased left a child or son's child, and 1/4 if not. Two or more wives share that fraction equally. In the RM285,000 example the wife receives RM 35,625.00.

Why does a son get twice a daughter's share?

The Quran (an-Nisa' 4:11) gives a son the share of two daughters when they inherit together as residuaries. Daughters without a son instead take a fixed share of 1/2 (one) or 2/3 (two or more).

What happens to the residue if there is no residuary heir?

In Malaysia it goes to the Baitulmal of the State Islamic Religious Council. Example: a wife alone takes 1/4 and Baitulmal 3/4. In Perlis, a 2018 fatwa returns the residue (radd) to the fixed-share heirs other than the spouse.

What is 'awl in faraid?

'Awl applies when the fixed shares add up to more than the estate: the base is raised so every share shrinks in proportion. Example: a husband (1/2) and two full sisters (2/3) total 7/6, so the base 6 becomes 7: husband 3/7, each sister 2/7.

Who is excluded (mahjub) from faraid?

A nearer heir excludes a farther one: a son excludes grandchildren, the father excludes the grandfather and all siblings, the mother excludes grandmothers, and a child or the father excludes uterine siblings. The husband, wife, father, mother, son and daughter are never wholly excluded.

How do I apply for a faraid distribution in Malaysia?

Get a faraid certificate (Sijil Faraid) from the state Syariah High Court. Then apply through the JKPTG estate distribution unit for small estates up to RM5 million, Amanah Raya for movable estates up to RM600,000, or the civil High Court for larger estates or where there is a will.
